TERMS AND CONDITIONS
ENTRY INTO THE COMPETITION
- This Survey Competition (the “Competition”) is conducted by GOLFNOW, LLC (ABN 31 890 543 427) of Level 32, 580 George Street Sydney, NSW 2000, Australia, telephone number: 1300 348 019 (“Promoter”).
- Information on how to enter forms part of the terms and conditions of entry. Entry into the Competition is deemed acceptance of these terms and conditions and all rules (“T&Cs”). If you submit an entry, or read the T&Cs and thereafter take any steps howsoever with respect to submitting an entry, or otherwise participate in this Competition, you are deemed to have accepted these T&Cs.
- The Competition is only open to eligible entrants being individuals who are permanent residents of Australia (the “Entrants”). The Competition is not open to officers, directors, management or employees of the Promoter or an employee of any related corporations or agencies of the Promoter or any other company or person associated with the Promoter, including family members.
- The Competition ends at 11:59 pm AEST on 9 July 2021 (“Competition Period”). The time of entry will in each case be the time an online entry is received. The Promoter accepts no responsibility for any late, lost or misdirected entries.
- To enter the Competition and be eligible to win, Entrants must:
- access the 'What are your golfing habits?'survey (“Survey”) sent by electronic direct email from the Promoter during the Competition Period.
- enter details into the Survey as requested and submit the fully completed Survey during the Competition Period.
- There is a limit of one (1) entry per person for the duration of the Competition Period. Entries from entrants using multiple email accounts are not permitted and all such entries will be disqualified and any Prize award forfeited.
- No purchase is necessary to enter this Competition, but costs associated with accessing the Survey remain an Entrant’s responsibility and may vary depending on the Internet service provider used.
- There are five (5) Prizes to be won in this Competition (“Winners”):
- First Prize Winner will receive $200AUD (two hundred Australian dollars)
- Second Prize Winner will receive $150AUD (one hundred and fifty Australian dollars)
- Third Prize Winner will receive $100AUD (one hundred Australian dollars)
- Fourth and Fifth Prize Winners will receive $50AUD (fifty Australian dollars) each.
- The Prizes are account credit to be used by the Winners for purchases on golfnow.com.au and/or iseekgolf.com.au websites or mobile apps.
- The total prize pool value is $550AUD (five hundred and fifty Australian dollars).
- The Prizes are not transferable, exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
- Five (5) Winners will be randomly selected from all entries received within the Competition Period, by computer randomisation.
- The Winners may selected after 1:00 pm AEST on 16 July 2021. The Winners will be notified before 1:00 pm AEST 23 July 2021 directly using the contact details provided in the Survey (“Winner Notification”).
- If the Promotes is unable to make contact with the Winners within twenty four (24) hours of the Promoter giving the Winner Notification, the Winner’s entry will be deemed invalid and the prize will be re-awarded.
- Entries not fully complying with these T&Cs may be deemed invalid at the Promoter’s discretion. If a winning entry is deemed not to comply with these T&Cs, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these T&Cs as if the discarded entry had not been received.
- Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- No responsibility will be taken by the Promoter, the Promoter’s agents for the Competition for any changes in dates, times or cancellations or other arrangements that may prevent a Winner from winning a Prize.
- If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
- to disqualify any Entrant; or
- subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
- In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prize (or a part of any Prize) it shall not:
- be liable to any person for any costs, loss or damage (including costs, loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
- be required to conduct the Competition at any other time.
- The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
- Nothing in these T&Cs limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
- any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- any theft, unauthorised access or third party interference;
- any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
- any variation in prize value to that stated in these T&Cs;
- any tax liability incurred by a Winner or Entrant; or
- use of or taking of the Prize.
- All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this Competition but no further use of this information will be made without prior consent.
- All personal information about Competition Entrants collected in connection with entering the Competition will only be used in accordance with the Promoter's privacy policy on the Website located at https://www.nbcuniversal.com/privacy to administer the Promotion, select the Winner, and where applicable arrange delivery of the Prize.
- The Competition and these T&Cs are governed by the laws in force the laws of each of the relevant State authorities. Each Entrant hereby submit themselves to the exclusive jurisdiction of the courts in each of the relevant state, for the resolution of any issue, dispute or matter arising under or in connection with the Competition and these T&Cs.
- By filling in the Survey Competition you will be entered into a draw to win one (1) first prize of $200 GolfNow account credit (“First Prize”), one (1) $150 GolfNow account credit (“Runner-Up Prize 1”), one (1) $100 GolfNow account credit (“Runner-Up Prize 2”), and two (2) $50 GolfNow account credits (“Runner-Up Prize 3 & 4”)
- We will send the Prize to the Winners by crediting your GolfNow account.
- The Prize account credit can used towards booking any tee time (Hot Deals or Course) via our websites GolfNow.com.au and iSeekGolf.com or the GolfNow.com.au mobile app.
- Please note that the Prize does not include and/or cover any costs, taxes, fees, expenses and/or arrangements not specified here. You are responsible for any other costs you incur (including costs for entering the Survey Competition, such as internet, mobile data charges).
- Also, you cannot transfer the Prize or receive cash for it as an alternative. And if the Prize becomes unavailable for any reason, we may substitute it with another prize of our choice.
- WINNERS SELECTION AND NOTIFICATION
- We will randomly select five (5) Winners for our What are your golfing habits? survey from all valid entries. Winners will be selected by 12:00pm 9 July 2021 by computer randomisation.
- We will notify the Winners via email after they have been selected by no later than 5:00pm 14 July 2021.
- Each individual Winner has to respond to our notification by 5:00pm 21 July 2021 to claim their Prize. We reserve the right to deem the selection as forfeited and may in our sole discretion, select another Winner. Proof of sending a response to us does not constitute proof of our receipt of the response.
- All personal information and materials concerning any applicants of the Survey Competition will be collected for the purpose of the Survey Competition (including administering, selecting the Winner and arranging the delivery of the Prize). We may store the information and materials submitted by you as part of your entry, in accordance with our privacy policy for a period of up to ninety (90) days.
- If you are selected as a Winner of our What are your golfing habits? survey, you agree to us and our group companies having the right to use your last name and county of residence, in any and all media. And you grant all consents and waive all necessary rights to enable us and our group companies to make the fullest use of this information in any and all media, worldwide, for a period of 90 (ninety) days, without any payment to you.
- If you want to find out who the Winner is, you can obtain this information by sending a written request, marked for the attention of the Marketing Team (enclosing a stamped self-addressed envelope so we can write back to you) to:
- Whilst we’ve tried to give you accurate information as far as we are able so that you can plan your entry accordingly, all dates and times referred to in these terms and conditions are subject to change and we will not be liable for any loss you may suffer if any of the dates change for any reason, even at short notice. You release us, our group companies, partners and employees from any and all liability, claims, demands and causes of action for personal injury and/or damage, theft and/or loss suffered in connection with the Survey Competition except where directly due to our negligence.
- We have complete discretion in all decisions made in relation to the Survey Competition. Our decisions in all matters are final and binding and no correspondence will be entered into except as set out in these terms and conditions.
- These terms and conditions do not create any right or benefit enforceable by any person not a party to them (within the meaning of the Contracts (Rights of Third Parties) Act 1999).
- We reserve the right to cancel, postpone and/or amend the Survey Competition and/or these terms and conditions at any time without prior notice if (i) any unforeseen circumstances or circumstances beyond our reasonable control make it reasonably necessary or prudent to do so; (ii) we need to in order for us to comply with any applicable law.
- We are entitled in our sole discretion at any time to disqualify any entrant from the Survey Competition without any liability if (i) that entrant and/or entry fails to comply with these terms and conditions. And/or (ii) in our reasonable opinion believe that an entrant has acted fraudulently, dishonestly, inappropriately and/or improperly in connection with the Survey Competition.
- If any part of these terms and conditions is determined to be illegal, void and/or unenforceable by a court of competent jurisdiction, then such part shall be severed and deleted, to the extent of such illegality, invalidity or unenforceability. The remaining parts of these terms and conditions shall remain in full force and shall continue to be binding and enforceable to the maximum extent permitted by law.
- These terms and conditions are governed by and construed in accordance with the laws of England and all entrants to the Survey Competition submit to the non-exclusive jurisdiction of the Courts of England and Wales.
